In today’s modern technological age, it is often hard to truly separate yourself from the workplace. Importantly, the Fair Labor Standards Act sets minimum wage rates and requires “nonexempt” employees (the vast majority of the workforce) to receive overtime wages at time and one-half the regular rate of pay for each hour worked over 40 hours in a workweek. With text messaging and emailing so second nature in today’s society, it is easy for employers to call upon employees when they are at home, on vacation or otherwise “off the clock.” This time away from the office is considered “compensable time” under the FLSA and must be paid for by the employer.
